The Supreme Court's Recent Ruling on Affirmative Action



On June 29, 2023, the United States Supreme Court made a landmark decision regarding affirmative action in college admissions. The court ruled that colleges and universities can no longer take race into consideration as a specific basis for granting admission. The decision effectively ended race-conscious admission programs at colleges and universities.


Chief Justice John Roberts wrote the opinion for the conservative majority, stating that the Harvard and University of North Carolina admissions programs violated the Equal Protection Clause because they failed to offer "measurable" objectives to justify the use of race. He claimed that the programs involve racial stereotyping and had no specific endpoint. The majority opinion claims that the court was not expressly overturning prior cases authorizing race-based affirmative action and suggested that how race has affected an applicant's life can still be part of how their application is considered.


The decision has been met with mixed reactions, with some applauding the ruling as a victory for equal protection under the law, while others see it as a setback for diversity and inclusion. The ruling is expected to have significant ramifications for the future of college admissions and affirmative action policies in the United States.
